Licence terms
In case of conflict, the German version prevails.
Scope
This licence text applies to TYG5 direct sales via tyg5.com. Purchases via the Framer Marketplace are additionally subject to Framer's own Marketplace terms, over which TYG5 has no control — in case of conflict between this document and Framer's terms for a Marketplace purchase, Framer's terms govern the purchase transaction itself; this document additionally governs usage rights in the Template.
§ 1 Licence grant
Upon purchase, the buyer receives a non-exclusive, non-transferable licence to use the purchased Template under the following conditions:
- One licence = one end product. The buyer may use the Template for one website/project. A further licence is required for a second project.
- Commercial use permitted. The buyer may use the Template for their own or commercial purposes, including for their own business.
- Client work permitted. Freelancers/agencies may deploy the Template on behalf of a client for that client's website — one licence per client project.
- Customisation permitted. Colours, content, structure, and images may be freely adapted.
§ 2 Expressly prohibited
- Reselling, redistributing, or publishing the Template itself — unchanged or modified — as a standalone product, on another marketplace, or for free
- Using individual sections/components from the Template as a standalone, separately sold product
- Claiming authorship of the Template design
§ 3 No warranty
The Template is provided "as is." TYG5 assumes no liability for damages arising from use of the Template, except in cases of intent or gross negligence. This wording is a placeholder and requires legal review.
§ 4 Support & updates
6 months of support from the purchase date — bug fixes for demonstrable defects, access to updates within this period. This is the consistent standard among genuine Framer Marketplace providers (e.g. Wrapmarket/Digiket: "Includes 6 months of support and access to future updates" for $49), and aligns with the established Envato/ThemeForest convention. Feature updates/new sections after this period are at TYG5's discretion; no personal setup support is included in the base price.
§ 4a Multi-site licence — Phase 4 only, after proof of concept
Not at launch. For the first 2–3 templates: standard licence only (one template = one website), consistent with the "start small, validate" strategy.
Structure for later, once the portfolio grows — real market comparison (LYNIQ template, Framer Marketplace): Standard $129 (one website) vs. PRO $159 (unlimited own websites) — roughly a 20–25% premium over the standard licence. For TYG5, correspondingly: multi-site tier roughly 20–25% above the standard price.
Important clarification many providers get wrong: a multi-site licence means unlimited websites owned by the buyer — not unlimited client projects for freelancers/agencies. Client work still requires one licence per client project, even with a multi-site tier. This distinction should be stated explicitly in the licence text once the multi-site option is introduced.
§ 5 Withdrawal (TYG5 direct sales only)
For purchases via tyg5.com: the purchase contract is concluded not with TYG5, but with the respective external checkout provider (Merchant of Record) — see Terms § 4. Consent to the early lapse of the withdrawal right under § 356(5) BGB is obtained there during checkout, not by TYG5 itself. TYG5 does not currently offer any additional goodwill window beyond the statutory position — see Withdrawal & Refunds.
For purchases via the Framer Marketplace, Framer's own refund policy applies, not this provision.
